Pay Transparency Manual/Poster Updates -- ACTION REQUIRED NOW!

The OFCCP's new Pay Transparency rules, effective January 11, 2016, require immediate updates to contractors' employment manuals and "EEO is the Law" posting. Read more below ....

 The Rules prohibits federal contractors from discharging, disciplining or discriminating against any employee or applicant because the employee or applicant has inquired about, discussed, or disclosed the compensation of the employee or applicant to another employee or applicant.  Similarly, contractors cannot have policies prohibiting employees for, discussing their compensation.  
In addition, under the new rules, contractors are specifically required to include in employee handbooks and disseminate or post physically or electronically for employees and applicants, the Pay Transparency Policy Statement reflected below.  Contractors must also post a supplement to the "EEO is the Law" poster that references the new pay transparency requirements.


The contractor will not discharge or in any other manner discriminate against employees or applicants because they have inquired about, discussed, or disclosed their own pay or the pay of another employee or applicant. However, employees who have access to the compensation information of other employees or applicants as a part of their essential job functions cannot disclose the pay of other employees or applicants to individuals who do not otherwise have access to compensation information, unless the disclosure is (a) in response to a formal complaint or charge, (b) in furtherance of an investigation, proceeding, hearing, or action, including an investigation conducted by the employer, or (c) consistent with the contractor’s legal duty to furnish information.
